Users may not use such content in any way that is not necessary or implicit in the proper use of the Service.
LoudPhone amplifies sound. Amplified audio can reach volumes capable of causing hearing damage. This Application is provided on an "as is" and "as available" basis for general listening convenience only.
Not a Medical or Hearing Device: LoudPhone is not a hearing aid and is not a medical device. It is not designed, intended, or approved to diagnose, treat, cure, or prevent any hearing condition or impairment. It is not a substitute for a professionally fitted hearing aid or for the advice of a qualified audiologist or physician.
Risk of Hearing Damage: Listening to amplified audio at high volume, or for prolonged periods, may cause permanent hearing loss. You are solely responsible for setting volume to a safe level. Start at a low volume and increase gradually. Discontinue use immediately if you experience discomfort, ringing in the ears, or any other adverse effect.
Situational Awareness: Do not use this Application in any situation where it may compromise your safety or the safety of others — for example, while driving, cycling, or operating machinery, or in any environment where you need to remain aware of your surroundings.
User Responsibility: The Owner is not liable for any hearing damage, injury, loss, or other harm resulting from the use or misuse of this Application, including from listening at unsafe volumes. If you have any concerns about your hearing, consult a qualified medical professional.
This Application and the Service may only be used within the scope of what they are provided for, under these Terms and applicable law.
Users are solely responsible for making sure that their use of this Application and/or the Service violates no applicable law, regulations, or third-party rights. Specifically, Users agree not to:
Recording-consent and wiretapping laws vary by jurisdiction. It is the User's sole responsibility to understand and comply with the laws that apply to them.
This Application offers paid subscriptions and a one-time lifetime purchase that unlock additional features. The following terms apply to all purchases.
Refunds are handled by Apple in accordance with the App Store's policies. The Owner does not directly process refunds for purchases made through the App Store.
Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy which the User may have under the Competition and Consumer Act 2010 (Cth) or any similar legislation and which cannot be excluded. To the fullest extent permitted by law, our liability to the User is limited, at the Owner's sole discretion, to the re-performance of the services or the payment of the cost of having the services supplied again.
This Application is provided strictly on an "as is" and "as available" basis. Use of the Service is at Users' own risk. To the maximum extent permitted by applicable law, the Owner expressly disclaims all conditions, representations, and warranties, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, in no event shall the Owner be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, or data, or for any personal injury including hearing damage, arising out of or relating to the use of, or inability to use, the Service.
To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates, or any other changes.
Users may not reproduce, duplicate, copy, sell, resell, or exploit any portion of this Application and of its Service without the Owner's express prior written permission.

The Owner reserves the right to amend or otherwise modify these Terms at any time. The Owner will inform the User of these changes.
These Terms are governed by the law of the place where the Owner is based, as disclosed in this document.
